Terms of Service
Terms of Service
These Terms are intended to make the customer purchase flow clear: what you are buying, how payments work, how tickets are delivered, when refunds may be available, and what happens if an event or payment plan changes.
They are written to match DayOf's current ticketing and Stripe checkout behavior while leaving room for event-specific policies that are shown on the event page or during checkout.
1. Acceptance and DayOf's role
These Terms of Service ("Terms") govern your use of the DayOf consumer website, DayOf-powered checkout flows, and related services for purchasing tickets, passes, or other access products. By using DayOf or placing an order, you agree to these Terms.
DayOf provides the storefront, checkout, ticketing, and related technology for venues, organizers, promoters, artists, brands, and other event partners. The event organizer, venue, or other seller identified on the event page or checkout may have additional event rules that apply to your purchase and attendance.
2. Eligibility and accurate information
You may use DayOf only if you can form a binding agreement and may lawfully purchase or hold the tickets or products offered. You are responsible for providing accurate, current billing, contact, and attendee information.
- Some products require attendee verification, a matching phone number, or other identity checks.
- Some events or venues may require a matching name or valid government-issued ID for entry.
- You are responsible for keeping your email address and phone number current so we can deliver tickets and receipts.
3. Orders, pricing, fees, and currency
Prices, taxes, service fees, and discounts are shown during the checkout flow. The currency displayed at checkout controls your purchase. Unless otherwise stated, DayOf currently displays prices in U.S. dollars.
- Your order is not complete until payment is successfully authorized or your free order is confirmed.
- Availability, pricing, taxes, and fees may change until checkout is completed.
- Promotions, discount codes, referral credits, or special access offers may have separate limits or eligibility conditions.
4. Payment authorization and secure processing
When you submit an order, you authorize DayOf, Stripe, and the relevant event partner or connected account to charge your selected payment method for the total amount shown at checkout, including applicable ticket price, taxes, and service fees.
Payments are processed securely by Stripe. DayOf does not store your full payment card number. Stripe may retain a payment credential associated with your purchase to support future authorized purchases, customer support workflows, or scheduled payments where permitted by law and network rules.
We will not initiate recurring or installment charges unless those future charges, schedule, and applicable cancellation terms are clearly disclosed to you before you confirm enrollment.
5. Ticket delivery and access
Tickets and passes are typically delivered digitally, including by email, through your DayOf account, or through Apple Wallet or similar wallet experiences when supported.
- You are responsible for reviewing your confirmation email and order details promptly after purchase.
- If you do not receive your confirmation or tickets, contact support as soon as possible using the information below.
- Tickets may be non-transferable, limited to a specific attendee, or subject to venue entry rules.
- Fraudulent, duplicated, altered, or resold tickets may be voided without refund.
6. Refunds, customer cancellations, and no-shows
Unless otherwise required by law, stated on the event page, or offered by the organizer or venue, all sales are final after an order is completed.
Refunds or credits may be offered in limited cases, such as:
- The event is canceled and not rescheduled.
- A duplicate charge, technical processing error, or other payment error occurred.
- The organizer, venue, or applicable law requires a refund or other remedy.
Unless required by law or explicitly stated otherwise:
- No refunds are available for missed events, late arrivals, schedule conflicts, or changes in personal plans.
- Certain taxes and fees may be non-refundable.
- If a refund is approved, it is generally returned to the original payment method and may take 5 to 10 business days to appear.
7. Event changes, postponements, and venue rules
Event dates, times, lineups, locations, performers, and other details may change. The event organizer or venue is responsible for the event itself and may establish additional event-specific rules.
- If an event is rescheduled, your ticket may remain valid for the new date unless otherwise communicated.
- If an event changes venues or other details, reasonable substitute performance or access may still satisfy the order.
- Admission may be denied or revoked without refund for violating venue, safety, or conduct rules, or for using a ticket contrary to these Terms.
8. Payment plans or future scheduled charges, if offered
Some products may offer an installment plan, subscription, deposit, or other scheduled payment option. If such an option is available, the checkout page will describe the payment amount, billing schedule, total cost, and any cancellation or failed-payment terms before you enroll.
- By enrolling, you authorize the future charges shown in that payment schedule.
- If a scheduled payment fails, we may notify you, request an updated payment method, suspend access, or cancel the order according to the disclosed plan terms.
- Any refund rights, forfeiture terms, or grace periods for that plan will be controlled by the schedule and disclosures shown at enrollment.
9. Support, disputes, and limitation of liability
If you have an issue with an order, please contact support before initiating a payment dispute or chargeback so we can review the issue and try to resolve it quickly.
To the fullest extent permitted by law, DayOf is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunity. DayOf's total liability arising out of or relating to your order or use of the services will not exceed the amount you paid to DayOf for the specific order that gave rise to the claim.
Nothing in these Terms limits rights that cannot be waived under applicable law.
10. Changes to these Terms and contact information
We may update these Terms from time to time by posting an updated version on DayOf. Material changes will apply prospectively unless otherwise required by law. Continued use of DayOf after updated Terms are posted constitutes acceptance of the revised Terms.
